Opinions of the Kentucky Court of Appeals - Fall Term - 1823
These are the opinions on cases brought by appeal from the county circuit courts to the Kentucky Court of Appeals in their Fall Term of 1823. All of the cases offered contain some type of genealogical information. Cases involving simple disputes between two men over the payment of a note, or others which did not contain genealogical information, were omitted. Many of the cases involve land disputes, which were the result of overlapping surveys and other claimed infractions while Kentucky was still a part of Virginia. Some of these cases date back to the time of the original Virginia patents in the years before 1792. These appeals court land claims began in 1792(and even before in the Virginia courts) when Kentucky became a state and continued for about 35 years afterward. In some cases, the given names of the Plaintiff or defendant or both are not shown in the original report, only the surnames. A few of these were included, because of the importance of the information they contained. From these opinions, a researcher could ordinarily request the complete case file from the repository where it was deposited. However, in Kentucky, a fire in 1862 destroyed all of the case files prior to that time in custody of the Appeals Court, so these opinions are the sole extant record of these cases until 1863, when the case files again become available.
